This crash occurred in Blair County, PA where this lawsuit was filed on behalf of our client. Ostroff Law won an important, precedent-setting decision in this case, which will allow other accident victims covered by Limited Tort insurance to go forward with claims if they didn’t reasonably know how serious their injuries were until well after their crash. The at fault driver’s insurance company in this incident attempted to deny coverage relying on a legal position that was based on when our client was aware of the seriousness of her injury. Ostroff Law partner William Coppol filed a legal action to appeal this legal position by the insurer. The case went up through the appellate process and the Pennsylvania Appellate Courts affirmed the legal position taken by Ostroff Law. As a result, this created important, clear new law in Pennsylvania that will allow other injured victims covered by Limited Tort insurance to go forward with their injury claim and receive fair compensation. Once this precedent was established, the at fault driver’s insurance company agreed to pay our injured client and fairly settle her case.
